These Terms of Use apply to the FeyCast iPhone app and website. By using FeyCast, you agree to these Terms.
The short version
- FeyCast provides general weather information, not emergency services.
- Weather data and alerts can be inaccurate, incomplete, delayed, stale, or unavailable.
- Do not rely on FeyCast as your only source for emergency warnings. Follow official warnings and local authorities.
- Premium subscriptions are sold and managed by Apple and renew automatically until canceled.
- Use FeyCast lawfully and do not scrape, overload, reverse engineer, or interfere with the service.
Apple standard EULA
For the iOS app, these Terms supplement and are layered on top of Apple's Standard Licensed Application End User License Agreement. They do not replace it. If these Terms conflict with Apple's standard EULA, Apple's standard EULA controls to the extent required by Apple or applicable law.
Eligibility
You may use FeyCast only if you can legally agree to these Terms where you live. If you are under the age of legal majority, a parent or legal guardian must approve your use. FeyCast is not directed to children under 13.
Weather information and safety
FeyCast combines information from government agencies, commercial services, public datasets, models, sensors, and other third parties. Weather is inherently uncertain. Forecasts, observations, radar, maps, estimates, history, and other information may be inaccurate, incomplete, delayed, stale, incorrectly located, or unavailable.
Notifications may be late, duplicated, incomplete, incorrectly targeted, or never arrive because of data-provider delays, internet or device conditions, operating-system settings, service outages, or other causes. Enabling an alert does not guarantee delivery.
FeyCast is not an emergency service and does not replace official warning systems, emergency services, professional forecasts, or advice from qualified authorities. Do not rely on FeyCast as your only warning source or use it as the sole basis for life-safety, aviation, marine, wildfire, medical, travel, or property-protection decisions. Follow official warnings and local authorities.
YOUR USE OF THIS REAL TIME WEATHER GUIDANCE APPLICATION OR WEBSITE IS AT YOUR SOLE RISK. WEATHER DATA MAY NOT BE ACCURATE. Apple Weather Data may vary from actual conditions due to variable factors, such as signal issues and geopolitical events, that can affect the accuracy of Apple Weather Data.
Third-party data and services
FeyCast displays or derives information from third-party providers. Providers retain their rights in their data and services. Attribution is available in FeyCast's Sources view and, where applicable, beside the relevant feature. Third-party terms may also apply to your use of linked services.
FeyCast does not control third-party data, availability, accuracy, licensing changes, or service interruptions. A provider may change, restrict, or discontinue data at any time.
Acceptable use
You may use FeyCast for personal, lawful purposes. Unless FeyCast gives you written permission, you must not:
- scrape, harvest, bulk-download, mirror, republish, resell, or commercially exploit FeyCast content or data;
- circumvent access controls, subscription checks, request limits, security measures, or technical restrictions;
- reverse engineer FeyCast, the WeatherKit APIs, or Apple Weather Data for any purpose, or probe, disrupt, overload, damage, or interfere with FeyCast or its providers;
- use automated systems to make requests at a rate a person could not reasonably produce;
- misrepresent FeyCast information as an official warning or use FeyCast unlawfully or to harm others.
Premium subscriptions
FeyCast Premium is an auto-renewing subscription offered through Apple's App Store. Apple is the merchant of record and processes payment. The App Store purchase screen shows the price, billing period, trial eligibility, and any localized taxes before you confirm.
Your subscription renews automatically at the displayed price and period unless you cancel at least 24 hours before the end of the current period, subject to Apple's rules. You can manage or cancel it in your Apple ID subscription settings. Deleting FeyCast does not cancel a subscription.
Free trials, if offered and if Apple confirms you are eligible, convert to a paid subscription when the trial ends unless canceled in time. Apple handles billing questions and refund requests under its policies. FeyCast cannot issue App Store refunds directly.
Features, prices, trial offers, and free or Premium limits may change. Any price change to an existing subscription is handled through Apple's required notice and consent process.
FeyCast content and feedback
FeyCast, its design, software, branding, and original content are owned by Marcus Fey or licensed to FeyCast. These Terms give you a limited, personal, revocable, non-transferable right to use the service. They do not transfer ownership. If you send feedback, you allow FeyCast to use it without obligation or compensation, while you retain rights in your original material.
Service changes, suspension, and termination
FeyCast may add, change, suspend, limit, or discontinue features or data sources, including free and Premium features. FeyCast may suspend or terminate access when reasonably necessary for security, legal compliance, provider restrictions, abuse prevention, nonpayment, or a violation of these Terms.
You may stop using FeyCast at any time. Canceling a subscription and deleting the app are separate actions. Sections that by their nature should survive termination, including ownership, disclaimers, liability limits, and dispute provisions, will survive.
Disclaimers
To the fullest extent permitted by law, FeyCast is provided as is and as available, without warranties of accuracy, completeness, timeliness, availability, fitness for a particular purpose, merchantability, non-infringement, or uninterrupted operation. FeyCast does not warrant that alerts will arrive or that data will be suitable for any particular decision.
Limitation of liability
To the fullest extent permitted by law, Marcus Fey and FeyCast will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits or data, personal injury, property damage, missed warnings, or decisions made or not made using FeyCast, even if the possibility of harm was known.
To the fullest extent permitted by law, total liability for all claims relating to FeyCast will not exceed the amount you paid for FeyCast during the 12 months before the event giving rise to the claim, or US $10 if you paid nothing. Some places do not allow certain exclusions or limits, so these limits may not apply to you.
Mandatory rights and savings clause
Nothing in these Terms excludes, restricts, or limits liability or consumer rights that cannot legally be excluded, restricted, or limited. Mandatory rights under the laws that apply to you continue to apply. If one provision is unenforceable, the remaining provisions stay in effect.
Governing law and disputes
Except where mandatory law requires otherwise, applicable law and conflict-of-law rules determine the law and forum for a dispute. Nothing in this section limits mandatory local consumer protections or your right to bring a claim where applicable law requires.
Language
The English version of these Terms controls. Translations are provided for convenience only. If a translation conflicts with the English version, the English version applies, except where applicable law requires otherwise.
Changes to these Terms
FeyCast may update these Terms to reflect service, legal, safety, or business changes. The updated date will change when revisions are posted. If a change materially affects your rights, FeyCast will provide additional notice where reasonably possible or legally required. Continued use after the effective date means you accept the updated Terms.
